SAP is not entitled to prohibit the commerce of used software

The Regional Court Hamburg (in a ruling from October 25, 2013, reference number 315 O 449/12, not yet final) noticed that two clauses of the terms and conditions of the producer SAP are anticompetitive. A company that used to buy software and to resell it has brought legal proceedings against SAP.

The applicant requested that the Regional Court declares that two clauses of the terms and conditions of SAP complicate the resell of used software and hinder competition. The Regional Court decided, on the one side, that the distribution of the software does not require the written consent of SAP, and, on the other, the clause of the so called 'measurement' is inadmissible. In the software sector, 'measurement' stands for the external control of how many individuals are making use of the software.
