Delimitation agreement
When there are striking similarities between two characters, the parties, instead of joining issue with each other, can come to a trademark delimitation agreement.
An agreement is the better solution especially when there is the likelihood of confusion because it is impossible to estimate the result of the legal proceedings due to the complexity of the diversity of the industries or due to the distinctive additives.
